Terms of use
These terms govern the use of the Incaelo app for Android and the purchase of Incaelo Pro through Google Play.
1. Who we are
Incaelo is an app by iRealWorks Apps. For any question about these terms or your purchase, write to soporte@incaelo.app.
These terms apply to the Incaelo app for Android from the moment you install it and, if you buy Incaelo Pro, to that purchase. If you do not agree with them, do not use the app.
2. Incaelo and Incaelo Pro
The free version of Incaelo is a complete product: tonight’s and tomorrow’s verdict with its five factors and their explanation, the notifications, the sky map, the events calendar and the regular catalogue. It does not expire and carries no ads.
Incaelo Pro adds, today, three features: the whole week night by night with the next good night; unlimited saved sites and the comparison of two sites for the same night; and the extended catalogue of about 1,800 objects with photo, description and altitude curve. The list may grow over time; we do not promise any feature that does not already exist when you buy.
Incaelo may change which features are paid, or make them free for everyone, without that giving a right to a refund, except for the unused part of a subscription, which is always refunded (section 7).
3. The seven-day trial
The first time the version of the app that includes Incaelo Pro starts, the app itself gives you seven days with every Pro feature open. It asks for no card, no account and no data: there is nothing to cancel. The trial never turns into a charge: on the seventh day the Pro features close and the free version stays complete. It is not a Google Play offer nor a trial of the subscription; the app runs it.
4. How purchases work
Incaelo Pro is bought inside the app, through Google Play, in one of two ways:
- Yearly subscription at €9.99 a year.
- One-time “forever” purchase at €19.99, a single payment.
Both prices include VAT. The exact price, in your currency and with your country’s taxes, is the one Google Play shows you at the moment of purchase.
Subscriptions and the one-time purchase are sold by Google Commerce Limited (Dublin, Ireland) through Google Play, which charges, renews, cancels and refunds under the Google Play Terms of Service and its refund policy. Incaelo never sees your payment details: not your card, your name or your billing address. What Google Play tells the app is whether your account holds the purchase, plus a code the app uses to confirm it back to Google.
5. Yearly subscription
The subscription renews automatically every year, at the current price, until you cancel it. You can cancel at any time in Google Play (Play Store › your profile › Payments and subscriptions › Subscriptions) or from the “Manage in Google Play” link under Settings › Incaelo Pro in the app. Cancelling does not refund the current period: you keep Incaelo Pro until the year you already paid for ends, and then you go back to the free version. If the price goes up, Google Play notifies you in advance and asks for your confirmation under its terms.
6. “Forever”
The one-time purchase gives access to the Pro features for as long as Incaelo is available on Google Play, with no further payments. It is not exclusivity over other users, nor a promise that the app will exist forever, nor a right to features that do not exist. If Incaelo stops being available, there will be no further charges of any kind.
7. Right of withdrawal and refunds
As a consumer you have fourteen days to withdraw from a distance purchase (article 102 of the Spanish consolidated General Law for the Defence of Consumers and Users, which transposes EU consumer law). Incaelo Pro is digital content delivered immediately: by buying it you consent to it starting at once and, for that reason, you waive the right of withdrawal (article 103(m) and the Google Play Terms of Service). This does not limit any right the law grants you.
Refunds are requested from Google Play under its refund policy. In addition, if one day Incaelo stops charging and becomes free for everyone again, we will refund the unused part of every yearly subscription, order by order.
8. Conformity and updates
Incaelo will release the updates needed to keep the app and the Pro features in conformity with what these terms describe during the legal guarantee period. If a Pro feature does not work as described, write to soporte@incaelo.app with your phone model and what happened; you are entitled to a repair, a price reduction or termination of the contract under consumer law.
9. Restore and new phone
The purchase is tied to your Google account, not to the phone. On a new phone, install Incaelo from Google Play with the same account and tap “Restore purchases” under Settings › Incaelo Pro; if the app has already read it from Google Play at startup, you will not need to.
10. Use and limitations
Incaelo’s forecast is an estimate made from weather models and astronomical calculations. Seeing is always estimated, never measured, and the app says so. Incaelo is not liable for a badly predicted night, a wasted trip or damage to your equipment from dew, wind or any other cause: decisions in the field are yours. The app is for personal use; the third-party data it includes (catalogues, photographs, maps, forecast) carries its licences under “Credits and sources” inside the app and may not be extracted or redistributed beyond what each licence allows.
11. Privacy
What data the app uses, what leaves your phone and what it keeps about your purchase is in the privacy policy, which forms part of these terms.
12. Governing law and complaints
These terms are governed by Spanish law. If you are a consumer, any claim is heard by the courts of your place of residence, and you also keep the protection of the consumer rules of your country of residence within the European Union. Before that, write to soporte@incaelo.app: most things are sorted out by email. You may also turn to the consumer services of your region or to an accredited alternative dispute resolution body for consumer disputes.
13. Changes to these terms
These terms are effective from the date above. If they change, we will publish the new version and its date here before it applies; changes do not affect what you have already bought, unless the law requires it or they are in your favour.
